By way of the present application, the applicant seeks grant of regular bail in case arising out of FIR bearing no. 316/2025, registered at Police Station South Rohini, Delhi for the commission of offences punishable under Sections 109(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereafter 'BNS').

Briefly stated, the present case was registered on the complaint of the complainant alleging that while he alongwith his friends was attending a party at Eagle Bar situated at W Mall, Sector-3, Rohini, Delhi, an altercation had taken place between his group and certain other persons including the present applicant and in the ensuing scuffle, the co-accused had caused fatal injuries to the deceased and that the present applicant/accused had actively The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The learned counsel appearing on behalf of the applicant argues that the co-accused, charged with graver offence, has already been granted bail. It is also argued that the applicant herein is only a few days above the age of 18 years and has clean antecedents. It is also stated that he has to appear in his Class XII Board Examinations which are scheduled to commence from 19.02.2026.

The learned APP for the State, on the other hand, argues that the allegations against the applicant/accused are very serious in nature and that the applicant herein was seen running after one complainant with a knife in his hand.

This Court has heard arguments addressed on behalf of the applicant as well as the State, and has perused the material on record. 6.
After hearing arguments and going through the case file, this Court notes that the main accused in this case has been granted regular bail, who had caused fatal stab injuries to the deceased. Further, it is also taken note by this Court that the role attributed to the present accused/applicant is that he had actively participated in the offence in question and had tried to hit another person with a knife and in the CCTV footage is seen running after the said person, however, no injuries were caused by him. 7.
Considering the overall facts and circumstances of the case, and for the reasons recorded hereinabove, this Court is inclined to grant regular bail to the applicant on his furnishing personal bond in the sum of Rs.10,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/Successor Court/Link Court/Duty Judge concerned, on the following terms and conditions:

i) The applicant shall not leave the country without prior permission of the concerned Court and if the applicant has a passport, he shall surrender the same to the concerned trial court.
ii) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned Court and IO/SHO concerned.
iii) The applicant shall appear before the Trial Court on every date of hearing unless exempted;
iv) The applicant shall not communicate with, or come into contact with the complainant or any of the prosecution witnesses, or tamper with the evidence of the case.

Accordingly, the present application stands disposed of. 9.
Nothing expressed hereinabove shall tantamount to an expression of opinion on the merits of the case.
