% 15.05.2018 The petitioner is the plaintiff of the suit (CS No.535/2017) for recovery of money, which was instituted on 02.06.2017. As per his case the respondents (defendants) were served on 14.08.2017. It appears that the written statement was not filed within the prescribed period. Written statement submitted on 23.01.2018 has been accepted by the trial court on imposing costs of Rs.3,000/-, thereby condoning the delay. It is the said order which is under challenge by the present petition. Having regard to these facts, this court declines to interfere with the judicial discretion exercised.

The petition and the applications filed therewith are dismissed. R.K.GAUBA, J.
