% 01.06.2016 Learned counsel for the parties agree for appointment of Justice Kailash Gambhir, retired Judge of this Court as sole Arbitrator. Noting the aforesaid submission, Justice Kailash Gambhir is appointed as the sole Arbitrator to adjudicate the claims and counter-claims, if any of the parties.

Learned Arbitrator shall comply with the provisions of the Arbitration and Conciliation (Amendment) Act, 2015. The fee of the Arbitrator shall be regulated as per Schedule - IV of the Arbitration and Conciliation Act, 1996 to be shared equally by both the parties. Any ancillary expenses to be incurred shall be paid by the parties as per actuals.

The petition is disposed of.
