By virtue of the present petition under 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioners seek quashing of FIR No.299/2017 dated 27.06.2017 registered at PS.: Tilak Nagar, Delhi under Sections 365/342/506/120B of the Indian Penal Code, 1860 (IPC) and all proceedings emanating therefrom, in view of the latest Memorandum of Settlement dated 06.11.2025, arrived at between the petitioners and the respondent no.2 & 3, which is accompanied by their respective proofs of identities.

Issue notice. Learned APP for the State accepts notice, and considering the nature of allegations involved herein, he objects to the quashing of the aforesaid FIR.

Respondent nos.2 & 3, who are present in Court, also accept notice and affirmed the terms of the aforesaid Memorandum of Settlement and have no objection to the quashing of the present FIR. 4.
The petitioners and the respondent nos.2 & 3 present in Court, present in Court, as well as their credentials, as on record, have been identified by the IO.

Even though the nature of the allegations and the provisions involved in the FIR are such which call for deliberations, however, since the petitioners herein are relatives of respondent nos.2 and 3, who have decided to continue with their marriage peacefully and a settlement has already been arrived at voluntarily between the parties, qua which they have also filed accompanying affidavit(s) herein, and also that the parties shall remain bound by all the terms and conditions thereof. As such, following the law laid down by the Hon'ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466, continuation of the present FIR against the petitioners will be an exercise in futility. 6.
Accordingly, the present petition is allowed and FIR No.299/2017 dated 27.06.2017 registered at PS.: Tilak Nagar, under Sections 365/342/506/120B of the IPC and all proceedings emanating therefrom are hereby quashed.
