The present petition has been filed on behalf of the petitioner under Section 14 read with Section 15(2) of the Arbitration and Conciliation Act, 1996 ("Arbitration Act"), seeking substitution/appointment of a Sole Arbitrator for adjudication of the disputes between the parties, in view of the elevation of the previous learned Arbitrator as a Judge of this Court. 2.
It is to be noted that the proceedings were pending before the Delhi International Arbitration Centre ("DIAC"). The petitioner had filed its statement of claim before DIAC, whereupon it was informed about the aforesaid elevation.

This Court notes that the approximate claim of the petitioner is the tune of Rs. 1,50,00,000/- (Rupees One Crore Fifty Lacs only), plus interest. 5.
Accordingly, considering the submissions made before this Court, a substitute Sole Arbitrator is appointed and the following directions are issued:
i.
Dr. N.P. Kaushik, Former District and Sessions Judge, Delhi, (Mob: +91-9910384663) is appointed as the Sole Arbitrator to adjudicate the disputes between the parties.
ii.
The arbitration proceedings shall be held under the aegis and Rules of Delhi International Arbitration Centre, Delhi High Court, Sher Shah Road, New Delhi.
iii.
The remuneration of the learned Arbitrator shall be in terms of DIAC (Administrative Cost and Arbitrators' Fees) Rules, 2018. iv.
The learned Arbitrator is requested to furnish a declaration in terms of Section 12 of the Arbitration Act prior to entering into the reference. In the event of any impediment to the Arbitrator's appointment on that count, the parties are given liberty to file an appropriate application before this Court.

It is made clear that all the rights and contentions of the parties, including, as to the arbitrability of any of the claim, any other preliminary objection, as well as claims/counter-claims and merits of the dispute of either of the parties, are left open for adjudication by the learned Arbitrator.
