This petition has been filed seeking directions prohibiting/restraining the Regional Director, Office of the Regional Director, Northern Region, Ministry of Corporate Affairs, from proceeding with the petition under Section 16(1)(b) of the Companies Act, 2013 ('Companies Act'). 2.

Mr. M.P.Srivignesh, counsel for petitioner, states that an application under Section 16(1)(b) of Companies Act has been filed by one Switchlabs Automobiles Pvt. Ltd., claiming to be a subsidiary of Ashok Leyland Ltd. and asserting that it is the registered proprietor of the Trademark "Switch", over which they claim proprietorship, and, therefore, have challenged the use and the corporate name of the petitioner/Company which is Switchlabs Automobiles Pvt. Ltd..

which has filed an application under Section 16(1)(b) of the Companies Act, is not the 'registered proprietor of the trademark' based on which it claims a right under the said provision.

Counsel appears for the Regional Director/respondent no.1 on advance notice, and states that these aspects can be decided by the Regional Director based on the provisions of Section 16(1)(b) of the Companies Act. 5.

Needless to state, this petition is premature at this stage. Application under Section 16(1)(b) of the Companies Act has not yet been decided or adjudicated.

At this stage, counsel for petitioner seeks to withdraw this petition with liberty to raise these issues before the Office of the Regional Director Northern Region, Ministry of Corporate Affairs. 7.

The language of Section 16(1)(b) of the Companies Act is clear and categorical and, therefore, the Regional Director/respondent no.1 shall consider the objections of the petitioner/Company. 8.

Petition is dismissed as withdrawn. Liberty is granted. 9.

Pending applications are rendered infructuous. 10.
