Cont. Cas. (C) 275/2018 This contempt petition has been filed for violation of order dated February 5, 2018.
Today, the learned counsel for the respondent, who appears on advance notice, has placed before the Court a communication dated April 17, 2018, addressed to the petitioners herein, intimating the decision on the appeal dated November 6, 2017. I may also state here, insofar as the
petitioner's representation is concerned, the stand of the respondent is as under:
"Vide order dated 05.02.2018, the Hon‟ble Delhi High Court has directed the 2nd Respondent to consider and decide the Petitioner‟s Representation and Appeal Annexure P-5 of W.P. No. 1008 of 2018).
Whilst the Appeal is a letter dated 06.11.2017 addressed to Director-Personnel and Industrial Relations against the new seniority list prepared to define Command Training Policy issued under Circular no. HOP/06-4381A/585 dated 19.06.2017, there is no representation on record despite the statement made in the court on your instructions that a Representation was filed in July 2017.
This office was unable to trace any such representation and has now obtained copy of a communication dated 14.07.2017 to Capt. Aditya Singh Dhillon, General Secretary of the India Ltd. Since this letter has not been addressed to Air India Limited, the same cannot be responded to specifically". In view of the above, the learned counsel for the petitioners, seeks to withdraw the contempt petition, so as to challenge the communication dated April 17, 2018 in accordance with the law. The contempt petition is dismissed as withdrawn.
