This hearing has been done through hybrid mode. 2.
The present petition under Section 25-B(8) of the Delhi Rent Control Act seeks following prayers:- "a) Call for the records of eviction petition being RC ARC No. 25982/2016, titled as "Shri Ravinder Singh & Anr. V/S Sh. Kashmira Singh & Ors" from the Ld. Administrative Civil Judge-cum-CCJ-cumAdditional Rent Controller, Tis Hazari Courts (West), Delhi. b) Set aside the Impugned Order dated 03.07.2025 passed by the Ld. Administrative Civil Judge-cum-CCJ-cumAdditional Rent Controller, Tis Hazari Courts (West), Delhi, in RC ARC No. 25982/2016. Any other order which this Hon'ble Court deem fit and proper in the facts and circumstances of the present case, may also be passed." 3.
On 06.04.2026 this Court passed the following order:- "2. premises and shifted their business to Mansarovar Apartments. Petitioner no. 1, who appears in-person, confirms the same.
3. In view of change in circumstances, it is submitted that he shall place on record a fresh affidavit of undertaking to vacate the subject premises within a period of 2 months, i.e., on or before 31.05.2026. Let the same be placed on record before the next date of hearing.
4. List on 20.05.2026."

In pursuance thereto, an affidavit has been placed on record, wherein it has been stated as under:- "9. That in compliance with the aforesaid order dated 06.04.2026 and without prejudice to the rights and contentions of the Petitioners in the present Revision Petition, the Deponent hereby undertakes to vacate and hand over peaceful, vacant and physical possession of the tenanted premises to the Respondent/Landlord on or before 31.05.2026. 10.That the Deponent further undertakes that the Petitioners shall not create any third-party interest, shall not sublet, assign, or part with possession of the tenanted premises in any manner whatsoever till handing over possession.
11. That the Petitioners further undertake not to cause any damage to the tenanted premises and shall hand over the same in proper condition, subject to normal wear and tear.
12. That the Petitioners undertake to maintain status quo with respect to the nature, character and use of the tenanted premises till the date of vacating the same."

Learned counsel appearing on behalf of the respondents submits that the petitioner should also clear the statutory dues, including water and electricity charges.

In view of the above, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition. 8.
