The present petition has been filed under Section 9 of the Arbitration and Conciliation Act, 1996, seeking permission to auction the Plant and Machinery taken in possession by the Petitioner under Clause 37.4 of the Concession Agreement.

Learned counsel appearing for the Petitioner, on instructions, seeks to withdraw the present petition with liberty to take such appropriate steps as are available under law. 3.

Liberty, as sought for, is granted.

Accordingly, the present petition stands dismissed as withdrawn.
