% 24.04.2018 Vide the present petition, the petitioner impugns order dated 14.10.2017, whereby the respondent has rejected his application dated 20.04.1989 for grant of alternate plot.
Learned counsel for the petitioner submits that the petitioner's case has been rejected on a wrong premise that his entire land had not been acquired. He submits that, while passing the impugned order the respondents, had not even followed the basic principles of natural justice, as they did not provide any opportunity to the petitioner to explain the position whether his entire land was acquired or not. Learned counsel for the petitioner submits that aggrieved by the impugned rejection, the petitioner has submitted a representation dated 27.11.2017, but the respondent has till date not responded to the same. He, therefore, submits that, for the present, he would be
satisfied if the respondent is directed to decide the petitioner's representation by passing a reasoned and speaking order. In view of the petitioner's assertion that, despite his fulfilling all the eligibility criteria, his application was rejected by the respondent without giving him a personal hearing or an opportunity to make any representation, the petition is disposed of with a direction to the respondent to pass a reasoned and speaking order on the petitioner's representation dated 27.11.2017 within 8 weeks, after giving him a personal hearing.
Needless to say that, in case the petitioner is aggrieved, it would be open for him to take legal recourse as permissible under law.
