This is the Defendant's [Appellant herein] first Appeal against the Judgment and Decree dated 04.09.2025 passed by the learned District Judge-01, (Commercial Court), Patiala House Court, New Delhi in CS (COMM.) No.89/2021 captioned Shri Achin Jain vs. Shri Sunny Arora, while decreeing the suit for recovery filed by the Plaintiff [Respondent herein].

During the pendency of the present Appeal, the parties have entered into a settlement, which has been reduced to writing as a Memorandum of Understanding (MoU). The Original Deed of Settlement along with the affidavits of both the parties has been produced during the course of this hearing and has also been taken on record as "Mark C-1 dated 27.01.2026."
