By way of this writ petition filed under Article 226 of the Constitution of India read with Section 482 of Cr.P.C., petitioner is seeking extension of parole for a period of two months on the ground of harvesting crops as his family is dependent on income from agriculture. 2.

Status report on behalf of the State has been filed which is to the following effect:- "It is further submitted that the financial status of the petitioner was also verified and it revealed that petitioner have 02 acres of agricultural land on his name and he has borrowed 33 acres of agricultural land on annual rent of ` 5,000/- per acre from the co-villagers for cultivation. The agricultural fields are also inspected and it was found that petitioner has sown wheat in all these agricultural fields and the crop is ripen at this stage. Apart from this, petitioner also keeps 17 buffaloes in the dairy managed and operated by the wife of the petitioner namely, Smt. Kavita with the one labourer.

Keeping in view of above facts, the crop has ripen and ready for harvesting and the subsidiary products from the wheat crop will be used as primary food for the buffaloes kept in Dairy. In view of the enquiry conducted it was found that the facts are true and genuine. However keeping in view the gravity of matter and considering the brutal murder of the deceased Late Suresh who was the only bread and butter earner of his family, the instant petition is strongly opposed." 3.

In view of the above fact which is verified by the State, the parole granted to the petitioner is further extended for a period of two weeks on the same terms & conditions as mentioned in order dated 29th January, 2016. 4.

Writ Petition stands allowed in the above terms. 5.

The Petitioner be informed through the Jail Superintendent about the order passed.
