The grievance of the petitioner is that the Court fee amounting to Rs.2,23,000/- (Rupees Two Lakh Twenty Three Thousand only) was, locked, in a recovery suit, which was neither pursued nor taken up for Court's consideration.

The gravamen of the dispute is peculiar, where the petitioner, after having purchased the Court fees, has decided to not pursue the suit, and thus seeks the refund of his Court fees.

In the facts of the case, the Court deems fit to direct for the refund of the Court fees to the petitioner as no suit was pursued, let alone an adjudication was undertaken.
