Applicant is seeking anticipatory bail in FIR No.79/2025 dated 10.02.2025, for commission of offences under Sections 318(4)/338/340(2)/61(2) BNS 2023 (corresponding Sections 420, 467, 471, 120B IPC), registered at P.S. Gokul Puri, Delhi. 2.

There are in all three accused persons in the abovesaid case. 3.

Two such accused persons, who are husband and wife, and who claimed themselves to be the owner of the property in question, entered into "Agreement-to-Sell" with the complainant and pocketed the "bayana" (earnest money). They both have already been arrested. The wife Mamta @ Kamlesh Devi is already on bail, albeit, on health ground, while her husband i.e. Rajender Prasad @ Vikram Gupta is in custody. 4.

The allegation against the present accused is to the effect that he was property dealer and was acting in connivance with the alleged seller-couple. 5.

However, according to petitioner, he was, merely a property dealer and though he had checked the property documents, he could not assess that the documents shown to him were false and fabricated. got a sum of Rs. 25,000/- as commission for the abovesaid property deal, which he is, even, willing to return.

Charge-sheet has already been filed.

The applicant is thirty four years of age, with no previous involvement. 8.

Keeping in mind the overall facts of the case, the application is allowed with the following conditions:- i. The applicant would join the investigation as and when so directed by the concerned SHO/IO.

ii. In case he does not co-operate, he would, automatically, become disentitled to the relief granted by this Court. iii. In the event of his arrest, he be released on bail by arresting officer upon his furnishing personal bond and surety bond in a sum of Rs. 25,000/- each.

Application stands disposed of in aforesaid terms. 10.

Pending applications also stand disposed of.
