It is noted that when the matter was taken up on 11.12.2025, this Court, upon noticing the absence of the parties as well as their counsels, posted the matter for 18.12.2025. However, on 18.12.2025 as well, none was present on behalf of the parties. Noticing the same, this Court directed the Registry to serve a copy of the order upon the counsels appearing for the parties and posted the matter for 08.01.2026. On 08.01.2026, again, none appeared for any of the parties and, on that date, Court notice was directed to be issued to the learned counsels for the parties. As per the office report, the Court notice has been served upon the counsels for the parties as well as respondent No. 3. However, there is no appearance on behalf of the parties.

In view of the aforesaid facts and circumstances, the appeal is dismissed for non-prosecution.
