Learned Counsel for the Plaintiff on instructions from the Plaintiff states that the Suit is being withdrawn without any coercion. Noting the said statement and on the basis of the identification by the learned Counsel for the Plaintiff of the Plaintiff, this Court is inclined to dismiss the Suit under Order XXIII Rule 1(4)(a) of the CPC, with liberty to file a fresh Suit on a fresh cause of action, which is not barred by limitation. 5.

In view of the above, the Suit is disposed of as withdrawn in the aforesaid terms.
