Through the present Petition, the Petitioners assail the correctness of the order dated 02.09.2024 passed by the learned Central Administrative Tribunal, whereby the Disciplinary Enquiry Report and the Disciplinary Order, which had been affirmed by the Appellate Authority on appeal, were set aside on the following two grounds:
i.
The Department did not examine any witness in support of the Memorandum of Charges; and ii.
The disciplinary proceedings initiated against Respondent No.1 were time-barred under Rule 9(2)(b) of the Central Civil Services (Pension) Rules, 1972.
2.
Learned counsel representing the Petitioners, at the outset, concedes that with regard to the first ground, the issue is squarely covered against the Department in view of the judgment dated The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 18.11.2024 passed by the Supreme Court in SLP(Civil) No. 29758/2018 captioned Satyendra Singh v. State of Uttar Pradesh & Anr.
3.
Learned counsel representing the Petitioners further submits that, since no witness was examined by the Department, the second ground raised by the Petitioners is purely academic and does not require any separate adjudication.
4.
In view of the above, the present Petition is dismissed. All pending applications also stand closed.
