The petitioner has filed this petition for quashing of FIR No. 64/2023 dated 24.02.2023 registered at Police Station Rani Bagh, Outer District, Delhi, under Sections 420, 467, 468, 471, 120B, Indian Penal Code, 1860.

The contention of the petitioner is that the dispute has been settled between the petitioner and the State Bank of India, which is the complainant-respondent No. 2 herein. not been filed. Instead, a copy of another document, namely a Reconveyance Deed dated 19.02.2023, has been annexed as Annexure A2 to the petition. Further, although it is stated in the petition that an order in a commercial suit between the parties was being filed as Annexure A3, the order filed as Annexure A-3 appears to pertain to an entirely unrelated suit, i.e., CS(COMM) No. 842/2023 [Sporta Technologies Pvt. Ltd. & Anr. v. John Doe & Ors.]. The filing is evidently made without due care and is a complete waste of the time of the Registry and the Court.

Mr. Neeraj Sharma, learned counsel for the petitioner, seeks permission to withdraw the petition with liberty to file a fresh one with the correct documents.

He is allowed to do so, but subject to deposit of costs of Rs. 7,500/- with the Delhi High Court Bar Association Costs Account [A/C No. 15530110179338; IFSC No. UCBA0001553; UCO Bank, Delhi High Court Branch] within a period of two weeks.

The petition is dismissed as withdrawn, with liberty as aforesaid.
