ORDER

% 05.08.2016 Present contempt petitions have been filed alleging wilful disobedience of the order dated 23"* December, 2015 whereby respondents were directed to take action and set up review Quality Assurance Selection Board (QASB) in respect of petitioners and to appraise and consider their case for promotion on all those dates they would otherwise have been eligible for consideration for promotion to higher post of Grades within a period of three months. Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing.

r Today Mr.Ankur Chhibber, learned counsel for the respondents has handed over minutes of meeting of the QASB held on 4^^ August, 2016. The same is taken on record. The relevant portion of the minutes of the meeting is reproduced hereinbelow:- "5. In view of the High Court judgment dt.23.12.2015, QASB

(3) 2016 considered the cases of Col GS Grewal and Col KP Kumar and found them eligible for promotion to the rank of Brigadier and accordingly recommended them as FIT for promotion in QASB (2) 2012 and QASB (2) 2014 respectively when they were first considered for promotion and vacancies were available for their promotion."

Mr.Chhibber also states that notices for reversion to Brig. P.C.C.Aggarwal and Brig.Rajeev Negi shall be issued on or before 9^^ August, 2016.

In view of the aforesaid decision of the QASB, the present contempt petitions and the applications are disposed of as satisfied. MANMOHAN,J AUGUST 05,2016 KA
