% 23.04.2018 Respondent no.2 is present in the Court and has been identified by SI Shri Gopal of police station Shakar Pur. He says that he has settled the matter with the petitioner voluntarily and without any undue force, pressure or coercion and he has no objection in case FIR No.253/2011 under sections 308/34 IPC registered at police station Shakar Pur and the consequent proceedings emanating therefrom are quashed qua the petitioner.
During the course of hearing it has been pointed out that petitioner and respondent no.2 were known to each other and a quarrel took place on some trivial issue which resulted in the incident leading to registration of the aforesaid FIR.
Matter is stated to have been settled between petitioner and respondent no.2 with the intervention of common friends and
relatives.
Keeping in view the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, FIR No.253/2011 under sections 308/34 IPC registered at police station Shakar Pur and the consequent proceedings emanating therefrom are quashed qua the petitioners only.
Petition is disposed of in the above terms.
