The present writ petition has been filed seeking a direction to the respondents no.1 to 3 to take action against the unauthorized construction at plot admeasuring 304 square yards in Kh. No. 376, Shaheen Bagh, Okhla, New Delhi carried out by the respondents no.4 to 6. 3.

petitioner that this Court does not have locus to entertain the present writ petition as admittedly, the petitioner is not living in the vicinity. 4.

Counsel appearing on behalf of private respondents have pointed out that the petitioner herein has filed a civil suit against the private respondents, which is pending adjudication before the Civil Court. 5.

In view thereof, counsel appearing on behalf of the petitioner seeks to withdraw the present petition.

Mr. Kumar Shashwat Singh, counsel appearing on behalf of MCD submits that MCD has already booked the unauthorized construction being carried out at the aforesaid plot and demolition orders have been passed in this regard.

Counsel appearing on behalf of private respondents submits that the petitioner is a part of a syndicate which indulges in extortionist activities and in this regard, a complaint has been filed before the concerned SHO. 8.

Counsel appearing on behalf of the petitioner submits that even the petitioner has filed complaints with the SHO regarding threats by the private respondents.

In view of the above, the present petition is dismissed as withdrawn. 10.

Needless to state, MCD shall take appropriate action against unauthorized construction in accordance with law. 11.

A direction is also issued to SHO (P.S. Shaheen Bagh) to investigate the complaints filed by the petitioner as well as the private respondents and take appropriate action in accordance with law.
