Ordinarily I would not have passed an order in this case because I had appeared as a counsel for the plaintiff, but since the matter has been settled, counsel for the parties state that only a formal order has to be passed and therefore I should take up the matter. Also, though this Court does not have pecuniary jurisdiction to try the present suit, but since the matter has been settled, I exercise my powers under Section 24 CPC read with Article 227 of the Constitution of India to retain the suit in this Court and dispose of the same by the present order. CS(OS) 1455/2008

Parties have entered into a settlement agreement dated 5.1.2016 before the Delhi High Court Mediation and Conciliation Centre. Parties have also signed the settlement agreement. Counsel for the parties state that the suit be disposed of in terms of the settlement agreement. Accordingly, suit is disposed of in terms of the settlement agreement dated 5.1.2016 and parties will be bound by the terms as stated in the settlement agreement. A decree be drawn up in terms of the settlement agreement dated 5.1.2016. Parties are left to bear their own costs.
