O R D E R

% 24.05.2018 In terms of the settlement agreement dated 04.05.2017 arrived at before the Delhi High Court Mediation and Conciliation Centre, New Delhi, the respondent had agreed to pay to the petitioner a total sum of Rs.70 lacs. The learned counsel for the petitioner confirms that the respondent has paid Rs.48 lacs. Today, in court the respondent has handed over two cheques for Rs.11 lacs each bearing Nos.182447 and 182448 dated 21.06.2018 and 21.07.2018, respectively both drawn on IDBI Bank, Gandhi Park Chauraha, Old Baijal Nursing Home, Firozabad, U.P. making it total of Rs.70 lacs. The respondent will ensure that the cheques when presented for clearing to the bankers are duly honoured.

The petition is disposed of. However, liberty is granted to the petitioner in case these two cheques tendered by the respondent today are not honoured to take steps as per law including seeking revival of winding up petition.

Mr.Rajender Prasad Jain, the Managing Director of the respondent company, who was directed to appear in person is said to be indisposed and hence has not appeared.
