This is a suit for specific performance. It is stated in the plaint that plaintiff was looking for a residential property. Therefore, the suit does not fall under the category of commercial dispute as defined under Section 2(1) (c) (vii) of the Commercial Courts, Commercial Division And Commercial Appellate Division of High Courts, Act 2016.

Vide notification number 27187/DHC/Orgl. dated 24.11.2015, the suit stands transferred to the district court. Defendant submits that the suit property falls in South Ex. Part-II which is in South East District.
