% 09.02.2026 CM. APPL.4371/2026 (condonation of delay in re-filing) By way of the present application filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023 ('BNSS'), the petitioner seeks condonation of about 22 days' delay in re-filing the criminal revision petition.

For the reasons stated in the application, which is duly supported by affidavit, the delay is condoned.

The application is allowed and disposed-of.

By way of the present petition filed under section 442 of the BNSS, the petitioner challenges order dated 27.11.2025 passed by the learned Family Court, Central District, Tis Hazari Courts, Delhi in Mt. Case No.278/2024, awarding an ad-interim maintenance of Rs. 50,000/- each to respondents Nos.1 and 2, being the wife and child of the petitioner. The court has perused the impugned order, which narrates the attempts by the petitioner to evade the proceedings by not being effectively represented before the learned Family Court (only sometimes by proxy counsel).

That apart, the order under challenge in these proceedings is an adinterim order; and the matter is listed before the learned Family Court on 24.02.2026 for completion of pleadings, examination of parties, and other proceedings.

In the circumstances of the case, and in view of section 438(2) of the BNSS this court is not inclined to entertain the present petition, which is dismissed at the stage of issuance of notice itself, without however making any observations on the merits of the matter. 8.
