BAIL APPLN. 826/2018 Learned counsel for the petitioner submits that petitioner had only facilitated a property deal between the complainant and co-accused Virender Singh @ Bablu. Disputes are purely civil in nature, inasmuch as a suit is pending between the parties in respect of the property deal. Learned APP has opposed the grant of anticipatory bail to petitioner. It is submitted that petitioner had conspired with co-accused and induced the complainant to pay `8,60,000/- on the pretext of sale of property bearing no.

142 Khasra/Khatauni no. 379, Qila No. 9, land admeasuring 60 sq. yds. Situated at Village Agwanpur, Agwanpur Extension, Faridabad, Haryana. Sale consideration was fixed at `10,15,000/-, out of which `8,60,000/- was paid to the petitioner. Petitioner had himself issued a receipt. Learned APP submits that custodial interrogation is required, inasmuch as cheated amount is to be recovered.

Keeping in mind the totality of the facts and circumstances of this case, I am of the view that petitioner is not entitled to anticipatory bail. Bail application is dismissed.
