The counsel for the respondent points out that the suit of the respondent (suit no.448/2015) was decreed by the Civil Judge by judgment dated 27.07.2017, copy whereof has been placed on record, it being stated that the appeal is now pending before the court of Additional District Judge. Since the order impugned in the petition at hand was passed at an interim stage, the petition has become infructuous and stands disposed of accordingly with the pending applications.
