The present writ petition has been filed seeking a direction to respondent no.1/MCD to demolish the unauthorised construction and amalgamation made by the respondents no.2 to 5 in the properties bearing no.4365 and 4366, Gali Bhairon wali, Jogiwara, Nai Sarak, Delhi and Property no. 4500, Daiwara, Roshanpura, Nai Sarak, Delhi. 2.
It is the contention of the petitioner that the petitioner is a co-owner of the subject property no.4365 Jogiwara, Nai Sarak Delhi-110006 to the extent of 12 1⁄2 % undivided share and the respondent no.2, being the other co-owner, to the extent of 37 1⁄2 % undivided share. 3.

the respondents no.3 to 5 are attempting to grab the aforesaid property. 4.
It appears from a perusal of the writ petition that there are inter-se disputes between the petitioner and other co-owners, which have resulted in the filing of the present writ petition.

No photograph has been filed along with the petition to show the nature of unauthorised construction, which is allegedly going on in the said property.

In view of the above, the present writ petition is disposed of, while directing the respondent no.1/MCD to inspect the property within one (1) week. In the event unauthorised construction/ amalgamation is found in the subject property, the respondent no.1/MCD is directed to take appropriate action in accordance with law.

Pending application also stands disposed of.

Needless to state, all rights and legal remedies of the owner/occupier shall remain protected.
