The present petition lays a challenge to the order passed by the Central Administrative Tribunal ['CAT'] dated 08.01.2025 in OA No. 1139 of 2023 whereby the Tribunal has allowed the petition filed by the respondent by stating in para 32 of the order as under: -

32. In view of above, the Original Application is allowed with following directions: - (i) Except for the amount of Gratuity, the respondent is directed to pay interest on the retiral dues of the applicant paid with delay at the rate of 18% from the date of superannuation till the date of actual payment within 12 weeks from the date of certified copy of this order: (ii) Interest on the delayed payment of gratuity shall be paid at the rate as applicable to GPP compounded annually; (iii) Respondent is also directed to pay Rs.25,000/- (Rs. (iv) Pending MAs, if any, stand closed.

The only submission made by the learned counsel for the petitioner is to the extent that the direction given by the Tribunal in paragraph 32 granting 18% interest to the petitioner on the retiral dues is untenable. 3.

He states he is not agitating the grant of interest on the gratuity at 12% per annum in terms of DOPT's OM of 1992.

Having heard the counsel for the parties and also the respondent, we are of the view that the grant of interest on retiral dues @ 18% is on the higher side. We reduce the same to 12%. Rest of the order of the Tribunal is not interfered with.

The petitioner shall comply with the directions of the Tribunal within six (6) weeks, if not already complied with.
