% 02.04.2018 The file is taken up today as 28.03.2018 was declared a holiday followed by court holidays till yesterday.

After some hearing, it has been jointly submitted and agreed by the counsel on both sides that the impugned order permitting amendment of the plaint be upheld, the challenge thereto having been withdrawn but the petitioner (the defendant in the suit) be given one more opportunity to file the written statement in answer to the amended plaint, such right having been subsequently closed. The petition is dismissed as withdrawn but the petitioner is granted opportunity with the consent of the counsel for the opposite party (plaintiff) to submit the written statement in answer to the amended plaint within four weeks hereof.
