% 02.04.2018 After some hearing, the learned counsel for the respondent fairly concedes that the prayer of the petitioner be granted and that it (the plaintiff of the suit) be given one opportunity to examine B.B. Puri whose name was already mentioned in the list of witnesses which was duly filed at the appropriate stage and further that opportunity for cross-examination of DW-1 also be given. The petition is thus allowed to above effect. The impugned orders declining such opportunity shall stand set aside. The learned trial judge will fix an appropriate date for the aforementioned opportunity to be availed by the petitioner.

The petition and the application filed therewith stand disposed of.
