% 14.01.2019 Mr. Sisodia, the learned counsel for the petitioners submits that because of petitioner No.2's age and infirm health, she may be examined through video conferencing or through commission. On a query put to him, whether the said witness is moving about, the answer is in the affirmative. However, he qualifies that she does need assistance of somebody to help her in movement because she is about 80 years old.

In the aforestated facts and circumstances, the Court is of the view that the impugned order dated 05.12.2017 does not call for any modification. The next date fixed by the learned Trial Court for recording evidence of petitioner No.2 is 23.01.2019. The petitioner No.2 shall appear before the Trial Court concerned on the said date at 12 o'clock. Due care shall be accorded to her in view of her frail health and medical condition, as may be. Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing.

Liberty is granted to the petitioners to approach the learned Trial Court in case of any difficulty.

The petitions, along with pending applications, stand disposed-off in the above terms.
