WP(C) No.2488/2017 & CM No.10720/2017 Learned counsel for the petitioner, after some hearing, states that he would be happy if the elections are held under the Administrator. The grievance of the petitioner is that the Administrator may enrol new members in place of the earlier members. The apprehension with regard to enrolment of new members, we perceive, is rather premature at this stage. 2.
Mr. Nagendra Deswal, Advocate is also present in Court and states
that he represent one Mr. Ram Kumar Sehrawat, who is a bonafide purchaser of one of the flats in Cooperative Society and wants to enrol himself as one of members. He states that this petition has been filed on behalf of the builder.

At this stage, learned counsel for the petitioner, seeks permission to withdraw the writ petition and states that he will raise all issues and contentions before the appellate authority, the Financial Commissioner, regarding appointment of the Administrator etc. Learned counsel for the respondents, during the course of arguments, has pointed out that the Financial Commissioner has been appointed vide the order dated 10.3.2017. 4.
In view of the statement made, the writ petition is dismissed as withdrawn. CM No.10720/2017 is also dismissed as withdrawn. It will be open to the petitioner to move an application for early hearing before the Financial Commissioner, who will examine the said application, keeping in view his Board.
