He, therefore, seeks permission to withdraw the present Suit in terms of Order XXIII Rule 1(3) of CPC with liberty to file a fresh Suit giving better particulars and appropriate prayers on the same cause of action. 2.

Permission and liberty, as sought for, are granted. 3.

The Suit is disposed of as withdrawn, along with pending application(s), if any.
