He claims that the subject properties were purchased by the father of the applicant, Mr. Syed Asif Ali in a public auction on 16th January, 1974. 5.

For the reasons stated in the application, the application is allowed and the applicant is impleaded as a respondent in the present writ petition. 6.

The application is disposed of accordingly.

Status report has been handed over by the respondent no.1/MCD in Court today and the same is taken on record. The status report states as follows:

i.

A show cause notice dated 18th December, 2025, was issued to the owner/builder in respect of unauthorised construction in the shape of part construction in the rear part of the subject properties. ii.

Subsequently, a demolition order in respect of unauthorised construction in the shape of Ground Floor, First Floor, and walls and columns raised at the Second Floor of the subject properties was passed on 12th January, 2026.

iii.

Pursuant to the said demolition order, demolition action was taken on 12th March, 2026, wherein three RCC panels on the roof of the Ground Floor and three RCC panels on the roof of the First Floor were cut/demolished.

Along with CM APPL. 34682/2026, the newly impleaded respondent has placed on record an order passed by the Appellate Tribunal, MCD (hereinafter 'ATMCD') on 24th April, 2026 in Appeal No.330/2026. In view thereof, the respondent no.1/MCD is directed to take further action in terms of the demolition order dated 12th January, 2026 based on the outcome of the said appeal.

In the aforesaid status report, the respondent no.1/MCD has also stated that on 10th April, 2026, fresh unauthorized construction was noted on the front portion of the property at Ground Floor and First Floor and entire unauthorized construction on Second and Third Floor, which was booked on 10th April, 2026 and a show-cause notice has been issued. Subsequently, a sealing show-cause notice has also been issued on 14th May, 2026. 11.

Counsel for the newly impleaded respondent submits that the showcause notice dated 10th April, 2026 as well as the sealing show-cause notice dated 14th May, 2026 has not been supplied to the newly impleaded respondent, Mr. Majid Ali.

11.1. Let the same be supplied within a period of one (1) week. 12.

Liberty is given to the private respondents to respond to the aforesaid show-cause notice dated 14th April, 2026 and the sealing show-cause notice dated 14th May, 2026 within two (2) weeks from today. 13.

MCD shall be at liberty to take action in terms of the show-cause notice dated 10th April, 2026 as well as the sealing show-cause notice dated 14th May, 2026 in accordance with law.

In view thereof, the present writ petition is disposed of in terms of the aforesaid directions.
