Aggrieved by the order dated 29.9.2017, counter signed by the respondent No.3 on 12.1.2018, confirming the order of dismissal from service dated 29.9.2017, passed by the respondent No. 4, the Disciplinary Authority, the petitioner has filed an appeal before the respondent No.2/DGBSF under Section 117 of the BSF Act, 1968, which is still pending.

Learned counsel for the petitioner submits that the petitioner had filed an appeal against his dismissal order before the respondent No.2/DGBSF, on 21.12.2017 but no orders have been passed thereon so far. He therefore confines the relief in the present petition to issuing directions to the respondents to consider the said appeal and pass a speaking order, in accordance with law.

Learned counsel for the respondents assures the court that the appropriate orders shall be passed by the competent authority on the pending appeal of the petitioner under written intimation to him. 5.
Accordingly, the present petition is disposed of, with directions to the respondents to pass a speaking order on the petitioner's appeal against his dismissal order within six weeks from today, under written intimation to him. If the petitioner is aggrieved by the order passed by the respondents, he shall be entitled to seek legal recourse, in accordance with law. 6.
