The third respondent is present in person and seeks adjournment. He submits that the negotiated settlement could not fructify as the petitioners have not co-operated in quashing of the case registered at Amroha, U.P. under Section 498-A IPC.

At this stage, the learned counsel for the petitioners, on instructions, submits that he may be allowed to withdraw the present petition and the application filed therewith and given liberty to file afresh for quashing of the case arising out of FIR No.142/2009, under Sections 323/325/341/34 IPC of Police Station Seelam Pur, after the case at Amroha, U.P. has been quashed. CRL.M.C. 1441/2016

The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for granted. Dasti under the signatures of Court Master.
