CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 24.07.2018 Respondent no. 2, the electricity company, has not disputed that the matter has been settled between the petitioners and respondent no. 2, inasmuch as settled amount stands paid. Counsel for respondent no. 2, on instructions, submits that respondent no. 2 and petitioners have settled the matter amicably and respondent no. 2 has no objection in case FIR no. 902/2016 under Section 135 of the Indian Electricity Act (Amend), 2003 registered at Police Station Neb Sarai and the consequent proceedings emanating therefrom are quashed.

Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.

A.K. PATHAK, J.
