The counsel for the plaintiffs states that the defendant no.2 Akshay Buildcon Pvt. Ltd. is a proforma defendant and the defendant no.3Ujjwal Sharma is also present in the Court and is not a contesting defendant. 5.

The person identified as defendant no.3 Ujjwal Sharma states he has no objection to withdrawal of the suit.

The parties to bear their own costs.

The counsel for the plaintiffs seeks refund of court fees. 9.

Out of the court fees paid of Rs.2,20,000/-, a certificate entitling the plaintiffs to refund of Rs.1,20,000/- be issued and handed over to the counsel for the plaintiffs.
