This hearing has been conducted through hybrid mode. 2.

The present petition has been filed under Article 227 of the Constitution of India, assailing the impugned orders dated 25th July, 2024 and 12th July, 2025, passed by the learned Trial Court in CS (COMM) 476/2021 and MISC. DJ 963/2024, whereby the suit filed by the petitioner was dismissed in default, and the application of the petitioner under Order IX Rule 9 of CPC, seeking restoration of the said suit has been dismissed. 3.

Learned Counsel for the petitioner submits that, against the impugned orders, an appeal is required to be filed, and therefore seeks liberty to withdraw the present petition with liberty to file an appeal. 4.

In view of submissions made by learned Counsel for the petitioner, the present petition is dismissed as withdrawn, with liberty as prayed for in accordance with law. All pending applications, if any, are also disposed of.
