This hearing has been conducted through hybrid mode. 2.
The present petition has been filed by the petitioners under Article 227 of the Constitution of India assailing the orders dated 02nd February, 2024 and 25th August, 2025 passed by the learned Trial Court in case bearing No. CS (COMM.) 115/2022, whereby the petitioners were proceeded ex-parte and the application of the petitioners under Order IX Rule 7 of the Code of Civil Procedure, 1908 has been dismissed.

During the course of arguments, learned counsel appearing on behalf of the petitioners submits that the learned Trial Court has rejected the plaint vide order dated 04th November, 2025 on the ground of territorial jurisdiction and the plaintiff has challenged that order in the Hon'ble High Court. Learned counsel for the petitioners seeks leave of the Court to withdraw the present petition, submitting that, as on date, no suit is pending before the learned Trial Court and so, liberty be granted to file a fresh petition if or when the need arises, in the event the order dated 04th November, 2025 is set aside.

Keeping in view the submissions of the learned counsel for the petitioners the present petition is disposed of as withdrawn with liberty, as prayed, in accordance with law. Pending application(s), if any, also stand disposed of.
