% 06.07.2018 Learned counsel appearing for the second respondent, on instructions, states that the said respondent/auction purchaser would be satisfied in case payment, along with interest accrued thereon, is refunded to the said respondent by the recovery officer. On the payment being made to the second respondent, the auction bid given by the second respondent would be treated as cancelled. We take the statement on record.

Learned counsel for the petitioner bank and respondent No.1 states that they have no objection in case money is refunded to the second respondent, along with interest accrued thereon. In view of the aforesaid statement, the writ petition is disposed

of, with liberty to the parties to ask for revival, in case there is any difficulty in implementation.

The second respondent will appear before the Recovery Officer on 18.7.2018 for the purpose of refund. Refund along with interest accrued on the amount deposited will be issued either by way of bank transfer or demand draft on or before 3.8.2018. Dasti under signature of the Court Master.
