% 17.08.2016 Petitioner is aggrieved by the fact that certain illegal and unauthorized construction is being carried out at property no. 189, Satya Niketan, New Delhi. His submission is that this construction is illegal and unauthorized.

Counsel for the respondent / SDMC has put in appearance on advance notice. He submits that his instructions are that demolition order has been passed qua ground floor and shuttering at first floor. Counsel appearing for respondent no. 6 submits that an appeal has been filed in the Appellate Tribunal i.e. ATMCD. Counsel for private

respondent informs this Court that the ATMCD has granted stay in his favour which is subsequently vacated. Matter is now fixed before ATMCD for December, 2012.

This petition is disposed of noting the afore noted submissions and in case the petitioner is still aggrieved that action has not been taken by the Department in accordance with the orders passed by the ATMCD he is at liberty to approach this Court. Petition disposed of.
