An affidavit has been filed by the petitioner for explaining the delay of six years in filing the present petition to assail the order dated 15th July, 2010, passed by the respondent-BSF. 2.
In the course of the arguments, it transpires that the relief prayed for in the present petition is limited to seeking modification of the order dated 15th July, 2010, passed on the statutory appeal filed by the petitioner, whereunder the order dated 1st May, 2006, passed by the Disciplinary Authority was upheld, without assailing the order of dismissal passed against the petitioner.

Learned counsel for the petitioner states that he may be permitted W.P.(C) 2950/2016
to withdraw the present petition and file a fresh petition wherein he shall challenge the order dated 1st May, 2006, passed by the Disciplinary Authority as also the order dated 15th July, 2010, passed by the Appellate Authority limited to the waiver of the shortfall of service, to claim service pension.

Leave as prayed for is granted.

The petition is dismissed as withdrawn.
