The petitioner has mixed up facts pertaining to an earlier inquiry where finally the penalty of forfeiture of seniority in the rank of CMO for one year was levied viz-a-viz an inquiry concerning a complaint made by Ct./S.K.(Recruit) Ajeet Singh of the 12th Battalion, Indo-Tibetan Border Police Force.

There are averments concerning application of the rule of double jeopardy. There are averments suggestive of the fact that the complaint by Ct./S.K.(Recruit) Ajeet Singh had no concern with the earlier inquiry. There is copious reference to the philosophy of the law concerning Austin view on legal theories.

Faced as aforesaid counsel seeks leave to withdraw the writ petition W.P.(C) 4364/2014

with right reserved to file a fresh petition on the same cause but projecting the cause clearly. The cause would relate to the challenging to the chargesheet issued after a preliminary inquiry was held concerning complaint made by Ajeet Singh.
