Admittedly, the appeal was dismissed in default and for nonprosecution on 09.01.2019. The CM No.3106/2019 was filed by the appellant for restoration and the application was allowed on 22.01.2019 and the appeal was restored to its original number. However, none appeared on 10.10.2019 when the appeal was listed for hearing after restoration.

Even today no one has appeared on behalf of either parties. It seems that appellant is not interested in pursuing the appeal. Consequently, the appeal is again dismissed in default and for nonprosecution. LCR be remitted forthwith. YOGESH KHANNA, J.
