W.P. (C) 2929/2016 While W.P. (C) 8186/2013 was disposed of as withdrawn vide order dated 16th November, 2015, learned counsel for the respondent had made a statement that earnest money shall be refunded, as per the tender conditions. Grievance of the petitioner in this writ petition is that respondent has not refunded the earnest money, despite specific statement to this effect. Learned counsel for the respondent submits that towards the earnest money bank guarantee and demand draft were furnished by the petitioner. Bank

guarantee has expired and demand draft was also not encashed and has became time barred. On instructions, she further submits that original bank guarantee and demand draft will be returned by the respondent to petitioner within one week.

Writ petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
