Learned counsel for the respondents states that he has obtained instructions from the Department to the effect that the relaxation given to one Shri Sanjiv Kumar by the Commandant (FTR) Frontier HQ. SSB, Patna is not in accordance with law and the said view has been communicated to the aforesaid officer with a direction to revisit the decision. 2.

On enquiring from learned counsel for the respondents as to whether the decision in the case of ASI (Ministerial) Sanjiv Kumar of the 26th BTN. for appearing in the LDCE 2017-2018 has been revisited by now and if so, indicate the decision taken, learned counsel states that a final decision shall be taken within three weeks.

We have enquired from learned counsel for the respondents as to the date when the LDCE 2017-18 examination is scheduled. He states that a W.P.(C) 3855/2018

firm date has yet to be fixed. However an assurance is given by learned counsel for the respondents on instructions from the Department that in the event, ASI (Ministerial) Sanjiv Kumar is permitted to appear in the LDCE 2017-18 on the basis of the relaxation given to him, then the petitioner shall be given a similar relaxation.

In view of the aforesaid submission, the present petition is disposed of along with the pending application. It is directed that in the event, the respondents maintain the relaxation given to ASI Sanjiv Kumar of the 26th BTN., by holding him eligible to participate in the LDCE 2017-2018 for the post of SI (Ministerial), then a similar relaxation shall be extended to the petitioner as well.
