Learned Counsel for Respondent No. 3 submits that the only challenge in the present Appeal is on the quantum and that even previously the matter was dismissed in default and for non-prosecution. 3.

Learned Counsel for Respondent No. 3 further submits that since the Insurance Company did not challenge the Impugned Award and the awarded amount inclusive of up to date interest has already been released to the Appellant.

It seems that the Appellant is not interest in prosecuting the present Appeal.

Accordingly, the Appeal is dismissed in default and for nonprosecution. 6.
