Petition under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of FIR No.0273/2014 under Section 354D/506 IPC read with Section 78 of BNS, 2023, registered at PS: Kotla Mubarakpur, Delhi on the basis of settlement arrived at between the parties. The terms of the settlement have been recorded by learned JMFC in Order dated 16.08.2024. 2.

The allegations in the FIR are that Petitioner and Respondent No.2 were known to each other as they had studied in the same school in the year 2012. Petitioner proposed Respondent No.2 for marriage, but her family did not agree, which agitated the Petitioner, who started making vulgar and abusive posts on the Facebook.

The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Settlement with their wish and will.

Respondent No.2 is present and submits that she has no grievance against the Petitioner and also no objection to the quashing of FIR. 6.

Considering the nature of allegations, their statements and since Respondent No.2 has also given no objection to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR.

Consequently, FIR No.0273/2014 under Section 354D/506 IPC read with Section 78 of BNS, 2023, registered at PS: Kotla Mubarakpur, Delhi and all consequential proceedings emanating therefrom are quashed. 8.

The Petition along with pending Application is disposed of. NEENA BANSAL KRISHNA, J.
